 Important Information If You Have Been

Arrested or Detained

    Know your rights!

You are not required to speak to or provide a statement to law enforcement, whether you are a suspect or not.  You should never provide a statement to law enforcement without the presence of legal representation.  If you are under arrest,  say nothing other than provide your booking information.  Your silence cannot be used against you in court.

If you are arrested do not physically resist in any way.  Don't bother trying to talk your way out of your arrest, it won't happen.

While in custody, you have the right to make three telephone calls,  preferably an attorney, within three hours after your arrest.  That's three completed telephone calls.

If you are not a U.S. Citizen you have the absolute right to contact, without delay, someone for your consulate or embassy.

You have the right to be informed by the arresting officer of the (1)cause of the arrest, (2)the authority to make the arrest, and (3)the offense for which you are being arrested.

You have the right to be taken without delay to a magistrate.

If you are stopped by an officer, who does not have a warrant to search,  you have the right not to consent to the search.  If the officer proceeds to conduct a search, do not attempt to physically prevent the search.  Do, however, document as best possible your refusal to give consent to search.

If you are arrested for driving under the influence, you are required to submit to either a blood test or breath test.  In certain situations,  an officer can physically withdraw blood without your consent.  Your refusal to submit to either test will result in the suspension or revocation of your driving privileges in California.  If you submit to a breath test,  you also have the right to request a blood test to preserve your blood alcohol level for later testing.
